Effective October 22, 2026. This policy applies to physical merchandise purchased from Form An Legacy, including apparel, footwear, accessories, original artwork, prints, collectibles, branded merchandise, and custom or made-to-order goods. Memberships and digital content are governed by their separate terms.
ALL CLOTHING SALES ARE FINAL
All clothing and apparel sales are final. No voluntary returns, exchanges, cancellations, or refunds. Once payment is accepted and an order is confirmed, we do not offer voluntary returns or exchanges due to buyer's remorse, incorrect customer-selected size, color or style, personal preference, or customer ordering errors. Customers must review product details and sizing before paying. This does not limit any statutory right to cancel or obtain a remedy.
OTHER PHYSICAL MERCHANDISE — FINAL SALE
Artwork, accessories, prints, collectibles, branded merchandise, and other physical goods are final sale unless an individual listing expressly offers different terms. We do not offer voluntary returns or exchanges for changes of mind or customer ordering errors. Mandatory consumer rights remain in effect.
CUSTOM DESIGN REQUESTS
The $5 custom design request fee covers preliminary review and agreed design services; it does not include a finished garment. The fee is non-refundable once the agreed design work begins, except where required by law or the service is not provided. Final garment pricing is disclosed separately; the garment payment becomes due only after the customer reviews and approves the proposed design and price. Once approved and paid, customized and made-to-order goods are final sale, subject to applicable law.
DAMAGED, DEFECTIVE OR INCORRECT ITEMS
Inspect products on arrival. Contact shopify.surpass198@passmail.com promptly, preferably within 14 days of delivery, with your order number, issue description, and clear photos where available. A 14-day reporting request does not shorten any legal remedy period. If an item is defective, materially misdescribed, or the wrong item was shipped, we will evaluate the claim and provide any remedy required by law, which may include repair, replacement, refund, or other appropriate resolution. We cover return shipping when legally required or when approving an eligible error-related return.
SHIPPING, LOSS AND DELIVERY
Customers must enter accurate delivery information. Delivery confirmation is evidence of fulfillment but does not conclusively bar valid claims. For lost, damaged, or disputed deliveries we may request reasonable documentation and carrier-claim cooperation. Remedies depend on the evidence, applicable law, carrier arrangements, and payment-provider rules. We do not guarantee voluntary refunds for unverifiable claims.
FRAUD AND MISREPRESENTATION
We may reasonably investigate, hold, refuse, or cancel orders suspected of unauthorized payment use, materially false information, or fraud. Refunds required for canceled transactions will be issued according to applicable law. Knowingly false claims may be contested with lawful records. Nothing restricts a customer's right to dispute unauthorized charges.
BUYER CONFIDENTIALITY
We treat customer contact details, sizing, custom requests, artwork selections, order and shipping information, and communications as confidential. We do not sell customer personal information. We share information as needed with authorized payment, fulfillment, shipping, fraud-prevention, and other service providers or where legally required. Our Privacy Policy governs personal-data practices.
PAYMENTS AND LEGAL RIGHTS
Payment acceptance and order confirmation establish the agreed sale, subject to statutory cancellation, consumer, warranty, chargeback, and refund rights. Shopify requirements and payment-processor rules also apply. If any provision conflicts with mandatory law, that law controls and the remaining provisions continue to apply as far as enforceable.
FORM AN LEGACY — ALL CLOTHING SALES FINAL. ALL OTHER PHYSICAL MERCHANDISE FINAL SALE UNLESS OTHERWISE STATED. STATUTORY RIGHTS RESERVED.
